IMPAX Receives Final FDA Approval for Fenofibrate Capsules ANDA; Eighth ANDA Approval of 2003 for IMPAX

HAYWARD, Calif.--(BUSINESS WIRE)--Oct. 28, 2003--IMPAX Laboratories, Inc. (NASDAQ: IPXL) today announced that the U.S. Food and Drug Administration (FDA) has granted approval to the Company's Abbreviated New Drug Application (ANDA) for a generic version of Fenofibrate Capsules, Micronized. Tricor(R) (Fenofibrate Capsules), Micronized was formerly marketed by Abbott Laboratories, Inc. (NYSE: ABT) for the treatment of very high serum triglyceride levels. According to NDCHealth, U.S. sales of Fenofibrate Capsules were approximately $1.4 million for the 12 months ended August 31, 2003. Abbott has previously discontinued sales of the capsule form and has replaced it in the market with a tablet formulation.

IMPAX currently has 17 applications pending at the FDA, including three tentatively approved, which address approximately $7 billion in U.S. branded product sales for the twelve months ended August 31, 2003. Fourteen of these filings were made under Paragraph IV of the Hatch-Waxman Amendments.
